A short, plain-English agreement.

The short version

Be a reasonable human. Don't try to break things. Your trips are yours, and you own them. OTrip is provided as-is — we'll do our best to ship a stable, accurate journal, but we can't promise it'll be flawless, and AI suggestions are always best-effort. Where the law allows, our liability is capped at what you paid us in the last twelve months (currently zero, since the app is free).

Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and the OTrip team ("OTrip", "we", "us") that governs your use of the OTrip mobile app, this website, and any related features (together, the "Service"). By installing, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please don't use the Service.

Eligibility

You may use OTrip only if you can form a legally binding contract under applicable law and you are at least 13 years old, or the equivalent minimum digital-consent age in your jurisdiction (for example, 16 in parts of the EEA, 14 in some EU member states). By using the Service you confirm that you meet these requirements.

Your account

You can use OTrip as a guest, in which case your record lives only on your device until you connect an account. When you do create an account using Sign in with Apple, Sign in with Google, or email, you are responsible for the activity on that account and for keeping your sign-in method secure. Please notify us at hi@otrip.app at once if you suspect unauthorised use.

You agree to provide accurate information when creating your account. We may suspend or terminate accounts that contain materially false information, that impersonate someone else, or that violate these Terms.

License to use OTrip

Subject to your compliance with these Terms, OTrip grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the OTrip mobile app on iOS devices you own or control, and to access the Service for your personal, non-commercial use.

You may not (and may not allow any third party to): (i) copy, modify, distribute, sell, or rent any part of the Service; (ii) reverse-engineer, decompile, or attempt to extract source code from the Service, except where applicable law expressly permits and you have first contacted us; (iii) use the Service to build a competing product or to replicate any feature or function; (iv) remove or alter any proprietary notices; or (v) use any automated means to access the Service, except as expressly permitted by us.

Your content

Trips, visits, goals, notes, stamps, and any photos you attach in OTrip are yours. We do not claim ownership of them.

To run the Service for you, you grant OTrip a worldwide, non-exclusive, royalty-free, fully-paid licence to host, store, transmit, sync, display, back up, and create the technical copies and derived data structures (such as resized images, search indexes, or trip clusters) that are necessary to operate the app on your behalf. This licence is limited to what's needed to provide the Service to you. It ends when you delete the relevant content or your account, subject only to the retention periods described in the Privacy Policy and to any need to complete a deletion already in progress or comply with law.

You represent that you have all rights necessary to grant this licence and that your content does not infringe the rights of any third party. You can export your full record at any time (Settings → Export trips) and delete your account whenever you want.

AI features

OTrip uses AI to draft trips from photo metadata, run the assistant, and compose summaries. These features call OpenAI through a backend we host on Firebase Cloud Functions. As described in our Privacy Policy, we send only structured metadata you have approved — not your photo files, not GPS traces, not free-text we haven't surfaced for AI use.

AI suggestions are best-effort and probabilistic. They can be incomplete, mistaken, or out of date. You are responsible for reviewing and saving the final travel record. Do not rely on AI suggestions for safety-critical decisions or anything that requires authoritative information (e.g. visas, border crossings, medical or legal matters).

You also agree not to abuse the AI features — no scraping, no automated scripting of the assistant, no attempts to extract training data, and no use that violates OpenAI's usage policies.

Acceptable use

You agree that you will not:

• Use OTrip in any way that violates applicable law, regulation, or any third party's rights.
• Upload, store, or share content that is illegal, infringing, defamatory, harassing, sexually explicit involving minors, or otherwise harmful.
• Access another person's account or data, or attempt to do so.
• Probe, scan, or test the vulnerability of the Service or breach any security or authentication measure.
• Interfere with or disrupt the Service or the servers and networks that host it, including by submitting malformed inputs or excessive automated requests.
• Access the Service via any automated system (bot, scraper, crawler) other than the official OTrip app.
• Use the Service to send unsolicited messages, distribute malware, or otherwise attempt to deceive others.

Subscriptions and in-app purchases

The Service is currently provided free of charge. If we introduce paid features or subscriptions in the future, they will be sold through the Apple App Store and governed by the App Store's billing, renewal, and refund rules in addition to these Terms. We will tell you the price, billing frequency, and renewal behaviour before you commit.

Subscriptions purchased through the App Store auto-renew unless you turn auto-renew off in your Apple ID account settings at least 24 hours before the end of the current period. Refund requests for App Store purchases are handled by Apple in accordance with the App Store Terms of Service.

Beta or pre-release features are offered "as is" for evaluation, may be incomplete or unreliable, may be discontinued at any time, and any data created with them may be reset when the feature exits beta.

Third-party services

OTrip integrates with third-party services to operate, including Google Firebase (Authentication, Firestore, Cloud Storage, Cloud Functions, Crashlytics, Performance Monitoring, Hosting) and OpenAI for AI features. Your use of features that rely on those services is subject to their applicable terms, in addition to ours. We are not responsible for the acts or omissions of third-party services.

Apple App Store rider

OTrip is distributed through the Apple App Store. The following terms apply specifically to your use of the OTrip iOS app and are required by Apple. In the event of conflict between this section and the rest of these Terms, this section controls with respect to your use of the iOS app.

• Parties. These Terms are concluded between you and OTrip only, and not with Apple Inc. ("Apple"). OTrip — not Apple — is solely responsible for the iOS app and the content of the iOS app.
• Scope of licence. The licence granted to you for the iOS app is limited to a non-transferable licence to use the iOS app on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the iOS app may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. OTrip — not Apple — is solely responsible for providing any maintenance and support services for the iOS app. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the iOS app.
• Warranty. OTrip is solely responsible for any warranties to the extent not effectively disclaimed. In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the iOS app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be OTrip's sole responsibility.
• Product claims. OTrip — not Apple — is responsible for addressing any claims by you or any third party relating to the iOS app or your possession and use of it, including (i) product-liability claims, (ii) any claim that the iOS app fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.
• Intellectual property. In the event of any third-party claim that the iOS app or your possession and use of it infringes that third party's intellectual property rights, OTrip — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of any such infringement claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
• Developer name and address. OTrip's contact information is below in the "Contact" section. You may contact us with any questions, complaints, or claims with respect to the iOS app.
• Third-party terms. You must comply with applicable third-party terms of agreement when using the iOS app (for example, your wireless data-services agreement).
• Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Intellectual property

The OTrip name, logo, app icon, editorial design system, source code, written content, and all related intellectual property are owned by OTrip and its licensors and are protected by intellectual-property laws. Except for the limited licence granted above, these Terms do not grant you any rights to OTrip's intellectual property.

If you believe content on the Service infringes your copyright, please contact us at hi@otrip.app with sufficient detail to identify the work, the allegedly infringing material, your contact information, a statement that you have a good-faith belief that the use is unauthorised, and a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the rights holder.

Feedback

If you send us feedback, suggestions, ideas, or proposals about the Service, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use them without any obligation to you. We are free to use feedback for any purpose without restriction. We appreciate it.

Disclaimer of warranties

Limitation of liability

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless OTrip and its officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (i) your use of the Service in breach of these Terms; (ii) your content; (iii) your violation of any law or the rights of any third party; or (iv) your use of any third-party service in conjunction with OTrip.

No travel or legal advice

OTrip is provided for personal recordkeeping. It does not provide travel, immigration, tax, legal, medical, or safety advice. Information in the Service may be incomplete or out of date. Always consult an appropriately qualified professional and authoritative sources before making decisions about visas, entry requirements, tax residency, or your safety.

Termination

You may stop using the Service at any time by uninstalling the app and, optionally, deleting your account from Settings → Account → Delete account.

We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if you breach these Terms, if we are required to do so by law, if continued provision of the Service would expose us to material legal or financial risk, or if we discontinue the Service. On termination, your right to use the Service ends immediately. Sections that by their nature should survive — including intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and miscellaneous — will survive.

Service and policy changes

OTrip may add, remove, or change features as the app evolves. We may update these Terms as the Service changes or to reflect changes in applicable law. When we make material changes we will surface a notice in the app and update the "Effective" date at the top of this page before the changes take effect. Continued use of the Service after that date means you accept the updated Terms. If you do not agree to a change, your remedy is to stop using the Service and, optionally, delete your account.

Governing law and dispute resolution

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the jurisdiction in which the OTrip team is established, without regard to conflict-of-law principles. Subject to the paragraphs below, the courts of that jurisdiction will have exclusive jurisdiction over any dispute.

Informal resolution first

Before filing any formal proceeding, you agree to first write to us at hi@otrip.app with a description of the dispute and the relief you seek, and to give us 60 days to try to resolve it informally.

Consumer protections

Nothing in this section limits the protections that apply to you as a consumer under the mandatory law of your country of residence. If you are a consumer in the EEA, the UK, or another jurisdiction with mandatory local consumer rules, you may bring proceedings in your local courts and benefit from the consumer protections of your local law.

Online dispute resolution (EEA)

Consumers in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and OTrip regarding the Service and supersede any prior understandings.
• Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
• No waiver. Our failure to enforce any right or provision of these Terms will not be a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets, or by operation of law.
• Force majeure. We are not liable for any failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, network or power failures, or labour shortages.
• Notices. We may give you notices through in-app messages, email, or by posting on this website. You agree to keep your contact details up to date.
• Headings. Section headings are for convenience only and do not affect interpretation.
